Terms of Service

These Terms of Service (“Terms”) govern your access to and use of myFamilyBudgetTracker (the “Service”), operated by [YOUR LEGAL ENTITY NAME] (“we,” “us,” “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. The Service

myFamilyBudgetTracker is a personal and family budgeting application that helps users plan budgets, track bank transactions, reconcile spending, set savings goals, and (on supported plans) categorize transactions using artificial intelligence.

2. Eligibility & Accounts

  • You must be at least 13 years old to use the Service. Users under 18 must have parental or guardian consent.
  • You agree to provide accurate, current, and complete information when creating an account and to keep it up to date.
  • You are responsible for safeguarding your password and for all activity that occurs under your account.
  • You may not use the Service for any unlawful purpose or in violation of these Terms.

3. Subscriptions, Billing & Free Trials

The Service is offered on a free tier and paid subscription tiers (currently “Pro” and “Family/Premium”). Paid plans are billed monthly or annually as you select at checkout.

Payments are processed by Paddle.com, Inc. (“Paddle”), our authorized Merchant of Record.Paddle handles billing, taxes (including U.S. sales tax), payment-method storage, and refunds on our behalf. By subscribing, you also agree to Paddle’s Checkout Buyer Terms.

Family tier free trial. The Family/Premium plan includes a free trial (currently 7 days) that requires a valid payment method at signup. If you do not cancel before the trial ends, your payment method will be charged for the first billing period automatically. You may cancel at any time before the trial ends to avoid being charged.

Automatic renewal.Subscriptions renew automatically at the end of each billing period unless cancelled. You can cancel any time from within the Service (Settings → Billing) or via your Paddle customer portal.

Refunds. Our refund practice is described in our Refund Policy.

4. Bring-Your-Own-Key (BYOK) AI

On the Pro tier, you may configure your own API key for an AI provider (Anthropic Claude, OpenAI, DeepSeek, or any OpenAI-compatible endpoint on our allow-list). When you do:

  • You are responsible for any charges or usage limits imposed by that AI provider.
  • We transmit your AI key from our servers to the AI provider over HTTPS to authorize each request you initiate. We do not use your key for any purpose other than fulfilling your requests.
  • We store your AI key encrypted at rest where supported. You can remove or rotate it at any time from Settings.

5. Managed AI (Family/Premium)

On the Family/Premium tier, AI categorization and analysis are provided as a bundled service using our infrastructure and API keys. Usage is subject to fair-use limits; we may rate-limit or contact you about abnormally high usage.

6. Your Content & Data

You retain all rights to the financial data, transactions, budgets, and other content you upload to or generate within the Service (“Your Content”). You grant us a limited, non-exclusive license to host, process, and display Your Content solely to operate and improve the Service for you.

When you upload a bank statement, transaction descriptions and amounts are sent to your configured AI provider for categorization or extraction. Bank account numbers, login credentials, and personally identifying details should be redacted before upload where your statement format includes them.

7. Acceptable Use

You will not, and will not attempt to:

  • Reverse-engineer, decompile, or copy the Service except as permitted by law.
  • Use the Service to store or transmit malicious code or unsolicited communications.
  • Probe, scan, or test the vulnerability of the Service without our prior written consent.
  • Use the Service in violation of any applicable law or third-party rights.
  • Share your account credentials with anyone outside your authorized household members.

8. Intellectual Property

The Service, including its software, design, trademarks, and content (excluding Your Content), is owned by [YOUR LEGAL ENTITY NAME] and protected by U.S. and international copyright, trademark, and other intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service in accordance with these Terms.

9. Termination

You may terminate your account at any time by deleting it from Settings. We may suspend or terminate your access to the Service if you breach these Terms, fail to pay for a paid plan, or use the Service in a way that risks harm to us, other users, or third parties. Upon termination, your right to use the Service ceases immediately.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that AI-generated categorizations or analyses are accurate, complete, or suitable for any particular purpose. The Service is a budgeting tool — it is not financial, tax, legal, or investment advice. Always consult a qualified professional for important financial decisions.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL [YOUR LEGAL ENTITY NAME], ITS OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY ARISING FROM OR RELATING TO THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

12. Indemnification

You agree to defend, indemnify, and hold harmless [YOUR LEGAL ENTITY NAME] from and against any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service in violation of these Terms or applicable law.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of [STATE OF YOUR BUSINESS], United States, without regard to its conflict-of-laws principles.

Informal resolution first. Before filing any claim, you agree to attempt to resolve the dispute informally by contacting us at support@myfamilybudgettracker.com. We will work in good faith to resolve the dispute within 30 days.

Arbitration. If informal resolution fails, any dispute arising out of these Terms shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in [CITY, STATE OF YOUR BUSINESS]. Each party waives the right to a jury trial or to participate in a class action. Either party may bring claims in small-claims court if they qualify.

14. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you (e.g., by email or an in-app notice) and update the “Last updated” date above. Continued use of the Service after changes take effect constitutes your acceptance.
